Terms & Conditions for Film Booth LLC's Thumbnail University

1. Introduction

• Thumbnail University is a YouTube thumbnail image feedback community and course designed to help educational/information based YouTube creators get more clicks.

Some examples of education/Information based channels:

• Tech channels
• Business & Marketing channels
• Relationship advice channels
• Health and fitness channels
• Finance channels

If you are unsure if your channel qualifies as an “educational/information based channel,” please email [email protected], and we will assist you.

2. Definitions

• "Participant": An individual registered for Thumbnail University.
• "Course Content": Materials, videos, and resources provided during Thumbnail University.
• “Thumbnail University - 1 year’s membership,” offered by Film Booth LLC.

3. Registration and Account Creation

• Age Requirements: Participants must be 18 years of age or older to register.
• Accuracy of Information: Participants must provide accurate and truthful information when registering.
• Account Security: Participants are responsible for maintaining the confidentiality of their account password on Thinkific and teach.io.

4. Course Fees, Payment, and Refund Policy

• The Thumbnail University fee is payable through methods specified at the time of registration.
• Refunds are based on members' activity. If participants complete the course and ask for feedback on every thumbnail for 30 days after its completion and see no results, they will be entitled to a refund.

A result is defined as an average increase in views per video. No results mean the image quality doesn't increase, or there is no progress on the channel.

5. Course Delivery, Duration, and Access

• Thumbnail University will be delivered via Thinkific, with community interactions facilitated through Discord.
• The membership is 365 days long, with participants having access to live calls once a month and as much image feedback as they ask for inside the Discord.
• Course content may be updated over time. All active members will have access to these updates.

6. Intellectual Property and Violations

1. All course content is the property of Film Booth LLC. Redistribution, sharing, downloading, or providing access to unauthorized individuals is strictly prohibited.
2. Violation of this term may result in one or more of the following actions:

1. Issuance of a cease and desist letter.
2. Seeking an injunction to prevent further violations.
3. Claiming damages or statutory damages.
4. Termination of the participant's account.
5. Confiscation of profits obtained from the violation.
6. Criminal charges, where applicable.
7. Engaging in alternative dispute resolution methods.
8. Enforcing contractual penalties as specified in the agreement.
9. Public statements may be made regarding the violation to deter similar actions by others.

7. Participant Conduct

• Participants are expected to maintain a respectful and helpful demeanor within the community. Offensive behavior, including but not limited to racism, sexism, aggression, and hate speech, will not be tolerated. Other behaviors deemed inappropriate by Film Booth LLC may also result in removal from Thumbnail University.

8. Privacy Policy

• All participant data is stored and managed in compliance with applicable data protection regulations. Further details on data handling and storage can be found in our detailed privacy policy.

9. Limitation of Liability

• Film Booth LLC is not responsible for any issues arising from the use of Thinkific, Discord, or any other third-party software recommended during Thumbnail University.
• Additionally, Film Booth LLC is not liable for technical malfunctions, data loss, or other disruptions caused by participants' equipment or third-party platforms, nor for indirect consequences of these malfunctions, such as missed deadlines or lost opportunities.

10. Termination

• Film Booth LLC reserves the right to remove participants from Thumbnail University for violations of the conduct policy, including offensive behavior as defined above, or for any other reason.

• Participants facing technical issues or having questions related to the course content should seek assistance through the community forum. Expected response times and support providers will be specified within the forum.

Thumbnail University Money-Back Guarantee Terms & Conditions

1. Guarantee Overview: If a YouTuber, after purchasing membership, watches every video in the course and asks for feedback on every thumbnail they produce after course completion, does not see a result in the following 30 days post completion, they are eligible to request a refund.

2. Eligibility Criteria: To be eligible for this guarantee:

1. You must complete the video course in full.
2. Ask for feedback on every thumbnail you produce.
3. Make every thumbnail and title before you have made your video, as this significantly increases your chances of getting results.
4. Get sign-off from the Film Booth team on your packaging before you post the video, which will likely mean you need multiple rounds of feedback.

3. Duration: This guarantee is valid for 60 days after sign up.

4. Conditions for Claiming: To claim the guarantee:

6. Refund Process: Refunds will be processed within 7-10 working days and will reflect in the buyer's account.

7. Dispute Resolution: Any disputes arising from this guarantee will be addressed directly by Film Booth, either through email or a Zoom meeting.

8. Safeguards: We reserve the right to verify all provided information, including earnings and view counts, to ensure the authenticity of claims. Any misrepresentation or fraudulent information will lead to disqualification from the guarantee. Additionally, in the process of verifying earnings or other sensitive information, we commit to maintaining the utmost confidentiality and will not share, distribute, or misuse any personal or financial data shared with us.

By purchasing Film Booth digital Products, you agree that if you win any competition hosted by the Company, you grant the Company the full rights to use your name, image, and any other personal information in any and all marketing materials, including but not limited to, email campaigns, social media, and the Company website.
11. Thumbnail University Membership Cancellation and Access
12. If you cancel your Thumbnail University membership with the Company, you will lose access to the content and the Discord community associated with the Products.
13. Governing Law
14. These Terms and any dispute arising out of or related to these Terms or the Products shall be governed by and construed in accordance with the laws of the United Kingdom without giving effect to any principles of conflicts of law.
15. Modifications
16. The Company reserves the right, at its sole discretion, to modify these Terms at any time and without prior notice. Your continued use of the Products following any such modification constitutes your acceptance of the new Terms.
